These terms apply to your use of the website of The Indian Kitchen, Biryani and Dosa, a restaurant at 3334 Yonge St, North York, Toronto, ON M4N 2M4. By browsing this site you accept them. If you do not agree with them, please do not use the site.
This site is here to show you who we are and what we cook. Everything on it, the menu, dish descriptions, prices, photographs, opening hours and event information, is provided for general information. We keep it as accurate as we reasonably can, but it may change at any time without notice, and it may occasionally be out of date or contain errors.
Photographs are of our food, but presentation and portions vary from plate to plate. Treat images as an impression of a dish rather than a promise about how it will arrive.
Prices shown on this site are indicative. They are not an offer, and they are not guaranteed. The price you pay and whether a dish is available are confirmed at the point of order, whether that is in the restaurant, over the phone or on a delivery platform. Where a price here differs from the price at the point of order, the point of order price applies.
Menu items can sell out, come off the menu seasonally, or change in preparation. Dietary and allergen notes on this site are a guide only. Our kitchen handles nuts, dairy, gluten and other allergens, and we cannot guarantee that any dish is free of them. If you have an allergy or a dietary requirement, speak to us directly before you order.
You cannot place an order or pay on this website. Our order links take you to third party platforms, currently Uber Eats and DoorDash. Once you are there, your order is a contract between you and that platform, subject to their terms, their pricing, their fees and their privacy policies. Delivery times, delivery fees, driver conduct, refunds and order accuracy on those platforms are handled under their rules, and we do not control them.
Submitting the catering form, the contact form or the reservation form sends us a request. It is not a booking, and it does not commit us to anything. Nothing is confirmed until someone from the restaurant replies to you and confirms it directly. Availability, final pricing, deposits and any other arrangements for an event are agreed in that conversation, not on this website.
We may decline a request, and we may need to change or cancel an arrangement if circumstances require it. If that happens we will tell you as soon as we can.
Please use this site lawfully and reasonably. Do not attempt to interfere with it, gain unauthorised access to it, scrape it at a scale that affects its operation, or submit content through our forms that is unlawful, abusive or deliberately false.
The Indian Kitchen name, logo, brand, and the content of this site including text, dish descriptions, photographs, design, layout and code, belong to The Indian Kitchen or are used with permission. You may view the site, and share links to it. You may not copy, reproduce, republish or use our content or branding for commercial purposes without our written permission.
This site links out to third parties, including delivery platforms, Google Maps and Instagram. Those links are provided for convenience. We are not responsible for the content, terms or practices of any site we link to.
This website is provided as it is. We do not warrant that it will always be available, uninterrupted or free of errors.
To the fullest extent permitted by law, The Indian Kitchen is not liable for any loss or damage arising from your use of this website, from reliance on information published on it, or from your dealings with any third party platform we link to. This includes indirect and consequential loss, such as lost profit or lost opportunity.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud. Nothing here affects your statutory rights as a consumer under Ontario or Canadian law.
We may update these terms from time to time. The current version is always the one published here, with the date shown at the top of this page. Continuing to use the site after a change means you accept the updated terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. Any dispute relating to this website or to these terms falls to the courts of Ontario, Canada.
